We trust this process will provide guidance on some areas that need to be addressed in considering a franchise.

We strongly recommend that you obtain independent advice on the contents of the franchise agreement from a solicitor that is experienced in franchising and we will recommended them to you if need be.

If you can, deal with advisers you already know, but make sure they have sufficient expertise in the specialist area of franchising.  They too, should provide you with a written disclosure of their experience and qualifications.  Only deal with advisors who can demonstrate that they have extensive experience, to do otherwise is inviting trouble.

At the end of the day, it will always be your decision.  Do not let that make you afraid to proceed, but let it awaken your awareness that risks are a part of business.

Be aware that when buying a franchise you are about to face the same challenges that would experience when purchasing any other form of business.  However being a ‘legal relationship’ it has added complications that must be researched and understood.

Any business acquisition, including a franchise, contains a commercial risk.  You must be prepared to take that risk if you wish to benefit from the rewards of business ownership.  The decision is yours and yours alone.

Buying a franchise system does appear to reduce the risks; however it is not a guarantee of success. Franchisees have been known to fail.

BDA formally counsels that you must investigate your choice of franchise using your own independent accounting and legal advisers.

Be sure that you retain the written material provided by your franchisor, including all sales brochures, disclosure documents and the agreements provided.

Never sign a franchise agreement without first seeking legal advice.
